O R D E R
PER: NARESH KATYAL, JUDICIAL MEMBER:
1. Vide application dated 30.11.2023, signed by Raj Kumar Sharma, being an authorized representative of complainant namely Smt. Urmila Devi Sharma; prayed has been made to withdraw this complaint. This application was forwarded to this Commission by Hon’ble National Consumer Commission through letter dated 07.12.2023 bearing No.A-12(SC)/NCDRC/2022 for taking appropriate action. On this forwarding letter; there is office noting dated 15.12.2023 to place the same before the Bench on date fixed. Date fixed was 16.01.2024. From 16.01.2024, the case has been adjourned for today i.e. 29.03.2024. Raj Kumar Sharma-authorized representative of complainant Smt. Urmila Devi Sharma through his E-mail dated 29.11.2023 has also sent his signed application dated 30.11.2023 to registry of this Commission.
2 Raj Kumar Sharma-authorized representative of complainant again moved this Commission through his letter dated 24.01.2024 to re-consider his application dated 30.11.2023 and to allow him to withdraw this complaint immediately. This letter dated 24.01.2024 was also sent to this Commission by Hon’able National Consumer Commission, vide letter dated A-12(SC)/NCDRC/2024 dated 16.02.2024 for taking appropriate action in the matter. On this letter as well there is noting of office of this Commission dated 11.03.2024 to place above communication before Bench for today (29.03.2024); which is the date fixed in this complaint.
3. In view of above facts; request received from Raj Kumar Sharma-authorized representative of complainant is accepted and this complaint bearing C.C. No.192 of 2019 titled as “Urmila Devi Sharma Vs. Dhiv Sai Infrastructure Pvt. Ltd.” stands dismissed as withdrawn. It is ordered accordingly. This order be conveyed forthwith to Hon’ble National Consumer Commission, New Delhi in reference to above two communications. Copy thereof be also endorsed to Raj Kumar Sharma- authorized representative of complainant.
4. A copy of this order be provided to all the parties free of cost as mandated by the Consumer Protection Act, 2019. This order be also uploaded forthwith on the website of the Commission for the perusal of the parties.
5. Application(s), pending, if any, stand disposed off accordingly in terms of this order.
6. File be consigned to record room alongwith a copy of this order.
