JUDGMENT

Per Sri Sushil Kumar,  Member- Due to sad demise of the ld. counsel for the appellant notice was served upon the appellant. Copy of the notice is available on record but none present to argue as well as none present for the respondent.

We have ourselves perused the judgment and order of the ld. District Consumer Commission who allowed the complaint directed the appellant to pay Rs.4 lacs which was paid by the respondent but tiles were not supplied inspite of getting the advance payment of Rs.4 lacs.

Therefore, the ld. District Consumer Commission directed to pay this amount after appreciation of the evidence available on record. We have found no ground to interfere with the findings of the ld. District Consumer Commission.

ORDER

   The appeal is dismissed.

          If any amount is deposited by the appellant at the time of filing of this appeal under section 15 of the Consumer Protection Act, 1986, may be remitted to the ld. District Consumer Forum concerned as per rules alongwith accrued interest upto date.

The stenographer is requested to upload this order on the Website of this Commission today itself. 

          Certified copy of this judgment be provided to the parties as per rules.
