Order dated : 18/04/2013

Heard submissions made by Complainant who submits that on 19.06.2012 he had sent his car for fixing of the HSRP at the office of the Shimnit Utsch India Pvt. The Compnay could not fix even after a frequent visits to get his car fixed with HSRP till date. Complainant hence filed this complaint on 12.07.2012 and prays that the Company should fix the HSRP either at his office or his residence and pay a compensation of Rs 5,000/- for the delay, deficiency in service and mental harassment.

Notices were issued to OPS but failed to enter appearance nor did they file any show cause except a copy of the letter dated 27.09.2012 of the Commissioner of Transport, Meghalaya submitted by Complainant which stated that the delay in fixing the HSRP was duly intimated to the Station Manager, Shimnit Utsch Pvt Ltd, Shillong and was reported that the Complainant refused to fix the same at his residence and advised him to intimate the Company the date and place to fix the HSRP at his convenient.

Complainant in his reply to the above letter stated that since he had already filed the complaint before the Forum he had nothing to sy but leave the decision at the discretion of this Forum.

 This Forum after hearing the Complainant and after examining of documents on record is of the opinion that:

There is neglignence in service by the OP by not being able to fix the HSRP in time though payment was made since 14.06.2012.

We therefore direct the OP to fix the HSRP at the convenience of the Complainant and to pay Rs 3,000/- as compensation for the delay and causing harassment to the Complainant. The OP to fix the HSRP within one week from the date of receipt of this Order.
