  1.  The complaint pertains to deficiency in service on the part of OP in providing hostel services.

 

  1. The brief facts as stated in complaint are: the complainant is a student of

Faculty of Law, Jamia Millia Islamia.It is alleged that allured by the website of OP, the complainant paid Rs.17,000/- toOP for providing hostel facilities. The amount included fees for one month i.e. 1st October to 1st November 2016, security deposit of Rs.6,000/- and annual fees of Rs.6,000/-.

It is alleged that the hostel lacked basic facilities such as lock on the door and lack of internet facilities.  The complainant complained to the authority concerned on 02.10.2016.  He left the hostel on 03.10.2016.  He demanded refund of amount paid on 04.10.2016 and sent a legal notice on 27.10.2018.

 

  1. The complainant prays for refund of Rs.17,000/- with 18% interest and Rs.15,000/- for compensation.

 

  1. Notice was issued and duly served on OP.  None appeared for OP who was proceeded ex-parte vide order dated 10.03.2019. 

 

  1. The complainant has filed evidence by way of affidavit and exhibit the following documents :
  1. Copy of the advertisement of hostel is exhibited as Exhibit C-1.
  2. Copy of fee deposited is exhibited as Exhibit C-2.
  3. Copy of legal notice is exhibited as Exhibit C-3.

 

  1. We have considered the material and documents on record.  Receipt dated 01.10.2016 shows that the complainant has paid Rs.17,000/- to OP. The complainant has admitted that he left the hostel on 03.10.2016.  The present complaint was filed on 29.01.2019.

 

  1. As per Section 24A of Consumer Protection Act, 1986, the complaint has to be filed within two years from the date of cause of action.  In the present complaint, the cause of action occurred on 03.10.2016 and complaint was filed on 29.01.2019 which is beyond the period of limitation prescribed in Consumer Protection Act,1986. 

 

  1. Hence the complaint is dismissed with no order to the costs.  Order to be uploaded and file be consigned to record room.
