ORDER

28-08-2015 – Due to long and uncertain period of absence of the Members, Single Member bench of President is functioning in their absence, in view of the order of Hon’ble National Commission in Revision Petition No. 4434 of 2014, in the matter of Mr. Netaji Surrendra Mohan Nayyar -vs- Citibank; and the judgement passed by Hon’ble Kerala High Court in the W.P. (C) No. 30939 of 2010 (N) P.K. Jose -vs- M. Aby & ors.

2.       Mr. Rajeev Kumar Sinha, learned counsel appearing for the appellant submitted that from the date of the receipt of free copy of the impugned order on 25.6.2015, this appeal has been filed within time and therefore limitation petition need not be filed.

3.       It appears that this appeal has been filed within time.

4.       Mr. Sinha submitted there was no deficiency in service. Moreover, the amount charged from the respondent/ complainant was already deposited in his account.

5.       From the impugned order, it appears that the complainant requested in writing on 7.10.2011 for discontinuance of the ‘Sweepin’ facility in his account with immediate effect, but the Bank deducted QAB charges for not maintaining minimum balance required to be maintained for ‘Sweepin’ account.

6.       The learned District Forum after holding that there was deficiency in service on the part of the Bank directed to pay compensation of Rs.4000/- within 60 days of the order, failing which, the complainant will also be entitled to recover the amount along with penal interest @ 12% P.A from the date of order till realization an amount of Rs. 2000/- was also awarded as litigation cost.

7.       After hearing, Mr. Sinha at length, in my opinion, no grounds are made out for interference with the impugned judgement. Accordingly, the appeal is dismissed. 

          Issue free copy of this order to all concerned for information and needful.
