Brief Facts of the case
The disposal of this complaint got delayed for over one year due to the renovation work at Forum.
Mr. Neel Kamal Trivedi purchased one new motor cycle (vide no. DL14SC6934) on 11/08/2013 for a sum of Rs 51,436/- from OP1 and got insured his vehicle from United India Insurance Co. from 12/08/2013 to 11/08/2014.
Complainant submitted that he got bill on dated 16/08/2013. He had submitted that his name was written on bill as N K Trivedi and not full name. He received temporary registration certificate under the name of full name.
Complainant approached OP 1 for correction of his name from initial to full name. OP 1 assured that he would get correct endorsement of his name as full in registration certificate.
Complainant made complaint to OP2 for deficiency in services of OP1 vide complaint no IND-12911. He got his bike serviced on 08/09/2013 and as bike had some abnormal sound coming from engine, the same was rectified. But the same defect was still persisting. So, he again made complaint to customer care vide complaint no. INB-14557.
As per complainant, his bike remained parked at his house and could run only 2976KM. He further submitted that neither abnormal sound was rectified nor got satisfactory services from OP1. Due to this, he suffered mental harassment and financial loss. So filed this complaint against OP1 and 2 claimed for refund of bike cost with mental harassment of a sum of Rs 145000/.
After perusal of complaint and annexure filed, notice were served to OPs. OP1 sales manager appeared and after receiving the copy of complaint, did not submit any written statement or filed any evidence even after giving number of opportunities. OP2 also not put up its appearance nor filed their written statement or any evidence. Hence, OPs were declared Ex Parte. Complainant filed his evidences on affidavit which are on record.
Arguments were heard. Order was reserved.
Taking merits of evidences filed by complainant, on affidavit, we have gone through the facts and evidence in this complaint, complainant has not shown any concrete evidence that he had suffered financial loss due to writing of initials of his name instead of full name. More so, he had submitted his voters ID zerox, which clearly reads as ‘N K Trivedi’ and not a full name as Neel Kamal Trivedi. Though, his registration certificate and driving license receipt had initials, his bike insurance and Pan Card showed his full name. But he did not produce any evidence that he had also submitted objection to RTO and Voters ID department for writing his name in initials.
We come to the conclusion based on his evidences and facts of the case, complainant has not suffered any mental harassment or financial loss due to writing of initials of his name instead of full name. Hence, this complaint is devoid of any merits and deserves dismissal.
Complaint is dismissed.
The copy of this order be sent to the parties as per rules and file be consigned to the record room.
