This appeal is coming up before us for final hearing on 23.7.2015 and on hearing the arguments of both sides and upon perusing the arguments of both sides and upon perusing the material records, this Commission made the following Order:
J. JAYARAM, PRESIDING JUDICIAL MEMBER
1. This appeal is filed by the opposite parties 1 to 4 against the order of the District Forum, Nagapattinam in C.C. No.95 / 2010, dated 30-03-2011, allowing the complaint.
2. The complainant has filed the complaint against the opposite parties 1 to 6 claiming compensation alleging monetary loss and loss caused to the crop raised in his land by adopting Drip Irrigation System provided by the opposite parties.
3. The opposite parties 1 to 4 and 6 did not appear before the District Forum, and they were set exparte and an exparte order was passed against them by the District Forum.
4. This appeal is filed to set aside the exparte order passed by the District Forum.
5. Considering the facts and circumstances of the case, we feel that an opportunity should be afforded to the appellants for proper adjudication of the case and to meet the ends of justice.
In the result, the appeal is allowed and the order of the District Forum is set aside and the case is remanded to the District Forum for proper enquiry and fresh disposal, on condition that the appellants 1 to 4 pay costs of Rs.5,000/- (Rupees Five Thousand only) each to the complainant on or before 25-08-2015, failing which, the appeal shall stand dismissed.
Both the parties are directed to appear before the District Forum on 26-08-2015. The appellants shall file their version, and proof affidavit, along with documents if any on that day itself.
The District Forum is directed to dispose of the case within three months from the date of appearance of the parties before the Forum.
