            Ld. Advocate for the complainant is present.

Heard the Ld. Advocate for the complainant who submits that the complainant is a monthly tenant in respect of one room with attached bath and privy measuring about 96 sq. ft. situated at Premises No. 38B/1, Abdul Halim Lane, Kolkata-700016 under the predecessor–in–interest of Late Gopal Chandra Ghosh, on his demise Late Subhas Chandra Ghosh and lastly under the OPs. He further submits that by virtue of an written agreement dated 31.08.2012 the OPs intent to construct a multi stored building on the said premises after demolishing existing structure standing thereon and in terms of the agreement the OPs are liable to deliver his proportionate portion of room on the said building but despite repeated requests the OPs did not hand over possession of the subject room. Hence, the consumer complaint.

            Having heard the Ld. Advocate for the complainant coupled with complaint petition along with its annexure thereto, we are of the view that the subject matter of the dispute is not amenable in this commission and the complaint is not admitted. As a result, the complaint is rejected.
