Final Order / Judgement

This order is arising out of MA 68/2022 in the CC/370/2020 filed by the Ld. Advocate Commissioner praying for withdrawal of his name as an Advocate Commissioner appointed by this Ld. Commission in the concerned Consumer Complaint.

This record is put up in view of the abovementioned MA being no. 68/2022. We take up the MA for hearing and disposal.

In the application Mr. Saikat Mali, Ld. Advocate was appointed as an Advocate Commissioner for holding local inspection so as to bring into the knowledge of this Commission, the nature and extent of possession of the Complainant in respect to the property in suit. Mr. Saikat Mali was directed to submit a report after local inspection of 06.05.2022. As per direction of the Ld. Commission, the Complainant deposited the remuneration of the Ld. Advocate Commission to the Registrar of this Commission amounting to Rs. 5,000/- along with writ.

Today by filing a petition Mr. Saikat Mali has been pleased to resign of being Advocate Commissioner in the said complaint and returned the remuneration for Rs. 5,000/- along with writ to the Registrar-in-Charge of this Ld. Commission. In view of the application filed by Mr.  Mali, Ld. Advocate, Mr. Saikat Mali is hereby released.

It is seen by us that for local inspection an Advocate Commissioner is very much required, otherwise we cannot reach at the conclusive conclusion. Therefore Ms. Madhumita Saha, Ld. Advocate is hereby appointed as Ld. Advocate Commissioner for holding local inspection, so as to bring into the knowledge of this Commission, the nature and extent of possession of the Complainant in respect to the property in suit.

Ms. Madhumita Saha, Ld. Advocate Commissioner is hereby requested to intimate the both parties by issuing written correspondences well ahead of her inspection, so that the parties can be present at the site at the relevant time. In the said letter it is mandatory to mention time and date for holding inspection.

Parties are directed to extend their extreme co-operation to the Ld. Advocate Commission, so that the entire inspection can be done without any hazards.

The Ld. Advocate Commissioner is hereby directed to receive the writ and the remuneration for Rs. 5,000/- from the Registrar-in-Charge of this Ld. Commission without any further delay.

Todate.

On that date submission of the report by the Ld. Advocate Commission will be fixed in presence of the parties.

With the abovementioned observation the MA 68/2022 in hereby disposed of allowing the same without any cost.

Let plain copy be given to the parties free of as per CPR.
