Content of the complainant petition is that the complainant Mukunda Chandra Mandal is a native of west Bengal, Malda District. He invested Rs.7,00,000/- (seven lakh) to the OP company namely Waris Finance & Investment Ltd. at several time under different scheme. The complainant invested Rs.7,00,000/- to OP-1 company in the year of 2011-2012
It is the fact that the time of returned maturity amount the OP-1 takes several times but they failed to give any payment to the complainant. Hence, it is an unfair trade practice on behalf of Waris Finance and Investment Ltd. and also deficiency in service at their part. He approach before this commission for returned his invested principal amount of Rs.7,00,000/- (which he deposited to OP-1) and interest Rs.9,00,000/- and litigation cost Rs.1,00,000/- and mental agony Rs.3,00,000/-.
OP-1 and 3 did not appear before this commission after received summons. Only OP-2 appeared before this commission. After that OP-3 came into this commission with order of Siliguri Circuit Bench and contests the case and filed W.V. also. The complainant deposited to the commission all the required documents.
:Decision:
In order to substantiate the complainant examine himself and file the Xerox copy of documents i.e. certificates of investment etc. OP-2 and 3 filed W.V. and OP-3 filed his written evidence. This commission carefully perused the untested testimony of the complainant and unchallenged documents and WNA. Considering all of this documentary and oral evidence, this commission is directing the OP company to disburse the principal amount Rs.7,00,000/- behind his investment and Rs.30,000/- for compensation for his mental agony and harassment.
Hence ordered,
that the complaint petition be and the same is allowed with a direction to the OP-1 to pay complainant principal amount of Rs.7,00,000/- behind his investment and Rs.30,000/- for compensation of his mental agony and harassment.
The Company is directed to clear the amount within 45 days from the date of this order i/d 6% interest will run on the entire amount until paid.
Complainant is also entitled to apply either U/S 71 or 72 of CP act 2019 if required.
Let a copy of the judgment be given to the complainant/ OPs at free of cost on proper application.
