Delay of 73 days in filing the revision petition is condoned.

We had directed learned counsel for the petitioner to take instructions as to pay Rs.20,000/- to the respondent as ex-gratia payment.  State Commission while dismissing the appeal filed by the complainant, had awarded Rs.20,000/- as ex-gratia payment. 

Learned counsel for the petitioner after taking instructions, states that the petitioner is agreeable to make the payment, although in “Revision Petition No.858/2009 LIC Vs. Prahlad Singh & Ors.  and other connected matters decided on 17.12.2009      has held that the ex-gratia payment can be made only if the person who is to make the payment is agreeable to do the same.  Since in the present case, petitioner has agreed to make the payment.  This revision petition is dismissed.
