ORDER

By ADV. RAVI SUSHA, MEMBER The complaint is filed for getting the value of UPS and for other reliefs. The complainant’s case is summarized as follows: Complainant purchased one UPS worth Rs.1800/- on 29.3.2006 from the opp.party. During the warranty period the UPS became unfunctioning . Complainant informed this fact to the opp.party. Opp.party has taken back the UPS for repairing with an assurance to return the said within one week. But it has not been returned so far. Hence the complainant filed complaint and prays for relief. The complainant was examined in chief as PW.1 and marked documents Ext.P1 to P3 [a]. The opp.party dared not to turn up. Hence stands declared exparte The point to be determined is whether the complainant deserves relief as prayed for. The complainant could prove his case through the complaint, affidavit, deposition in chief and the Exts. Marked. The complainant was heard. On perusal of the exhibits we find that there is deficiency in service on the part of the opp.parties. In the result, the complaint is allowed. The opp.party is directed to pay Rs.1800/- as value of UPS with 9% interest to the complainant. The opp.party is further directed to pay Rs.1000/- as compensation and Rs.500/- as cost to the complainant. The order is to be complied with within one month from the date of receipt of this order.
