CONSUMER CASE NO :- 31/2020
ORDER
The facts of the present case, in brief, are that the complainant ordered for spectrum Roofing Profile Sheet and Ridging on 30/07/2020 and in this connection paid to Opposite Party Shalini Roofing Pvt. Ltd. , Unit-ii an amount of Rs.76,075/- on 31/07/2020 through NEFT under State Bank of India, New Silchar Branch. The O.P. on receipt of the payment issued Tax Invoice No. TI/19-20/1034 dated 04/08/2020 and despatched the items booked. It is further stated that on receipt of the Roofing Profile Sheet and Ridging from Shalini Roofing Pvt. Ltd. Unit-ii the complainant executed the work of fitting the roof sheets in his premises and completed the work on 15/08/2020 and in this connection made payment of Rs.11,088/- as labour charge. Also for the purpose of fitting the roof screws were purchased for Rs.4,250/- from Cachar Traders, Silchar. That within a few days of fitting of the roof rust appeared on the roofings and in this regard the complainant lodged complain with the O.P. but the O.P. did not provide any solution. As a result, according to the complainant, he has suffered huge financial loss. The complainant has , therefore, prayed for passing award against the O.P. of Rs.76,075/- being the refund of cost of the roofings, an amount of Rs.1,00,000/- as compensation, an amount of Rs.50,000/- for mental agony and an amount of Rs.10,000/- towards cost of the suit.
It may be mentioned here that the Opposite Party did not contest and the case proceeded exparte against him. In due course the complainant submitted his evidence on affidavit as PW-1 and has exhibited some documents. In his evidence also the complainant has deposed that he ordered for spectrum Roofing Profile Sheet and Ridging and in this connection paid Rs.76,075/- to Opposite Party Shalini Roofing Pvt. Ltd. Unit-ii on 31/07/2020 through NEFT under State Bank of India, New Silchar Branch. The O.P. on receipt of the payment issued Tax Invoice No. TI/19-20/1034 dated 04/08/2020 and despatched the items booked. It is further stated by PW-1 that on receipt of the Roofing Profile Sheet and Ridging from Shalini Roofing Pvt. Ltd. , he executed the work of fitting the roof sheets in his premises and completed the work on 15/08/2020 and in this connection made payment of Rs.11,088/- as labour charge. Also for the purpose of fitting the roof screws were purchased for Rs.4,250/- from Cachar Traders, Silchar. PW- 1 has exhibited bank counterfoil of payment of Rs.76,075/- as Ext.-1, cash memo dated 15/08/2020 for fitting of the roof sheets as Ext.-2, cash memo dated 11/08/2020 for purchase of screws as Ext.-3 and Tax Invoice dated 04/08/2020 as Ext.-4 . Further version of PW-1 is that within a few days of fitting rust appeared on the roofings and in this regard he lodged complain with the O.P. but the O.P. did not provide any solution and intentionally ignored his genuine request. As a result, according to the complainant, he has suffered huge financial loss and he is entitled to compensation for the intentional disservice
caused to him by the O.P. It also has been alleged by PW-1 that the roofings and ridging sent by the O.P. were not in conformity to the order.
To substantiate his averments the complainant has submitted aforesaid Exts. 1, 2 ,3 & 4 papers/vouchers. In order to show that rust appeared in the roof sheets the complainant has also submitted the xerox copies of photos of the roof sheets vide Marks-a, b, c & d which clearly supports the version of the complainant. The papers submitted in the case also go to show that the complainant informed the matter to the O.P. but the O.P. took no step to solve the problem. Thus the materials available on record show that the complainant suffered loss and on the other hand by not solving his claim the O.P. caused disservice towards him. Accordingly, the complainant is entitled to get relief in this case.
In view of the above it is ordered that the O.P. shall either to replace the spectrum Roofing profile sheet and Ridging and to pay entire amount of Exts. 2 & 3 cash memos or to return an amount of Rs.40,000/- ( Rupees Forty Thousand) only being lump sum fifty percent of the value of the roof sheets to the complainant. The O.P. shall further pay to the complainant an amount of Rs 5,000/- ( Rs. Five thousand) only towards compensation for mental agony, harassment etc. and another amount of Rs. 5,000/- ( Rupees five thousand) only towards cost of litigation. The entire amount shall be payable within a period of 90 (ninety) days else interest @9% per annum would accrue on the amount from the date of order till realisation of the amount.
The case stands allowed in exparte against the O.P.
