Sh.Kapil Kumar, Advocates for OP. Dated, the 29th day of October, 2010. ORDER This case has been taken up today in the Lok Adalat. Counsel for OP has tendered post dated cheque in favour of complainant, bearing cheque No. 052351, dated 31.01.2011 amounting to Rs.1,04,000/- (i.e. Rs.50,000/- as compensation and Rs.54,000/- as interest w.e.f 1.6.2009 to 31.1.2011) drawn on Canara Bank, Sector 8-C, Chandigarh, for payment to the complainant. Counsel for complainant has accepted this cheque of Rs.1,04,000/- and withdraws the present execution application subject to realization of aforesaid cheque and with liberty to file fresh execution application, if need be. Statement of counsel for the parties to that effect has been recorded separately. Keeping in view the above, since the complainant has withdrawn the present execution application, subject to realization of aforesaid cheque and with liberty to file fresh execution application, if need be later on, the same is allowed and the present execution application is dismissed as withdrawn.
