ORDER

 

                        When notice of motion was issued on 20.02.2018, Counsel for the appellants confined his prayer only to the grant of compensation stating that it was on the higher side. To that limited extent, notice of motion was issued to the respondent, to which, Sh.Devinder Kumar, Advocate has put in appearance on behalf of the respondent by filing his Vakalatnama, which is taken on record. The respondent/complainant is also present in Court.

                        Heard Counsel for the parties.

                        At the time of arguments, very fair offer was made by Counsel for the respondent that let an amount of Rs.10,000/- be reduced from the component of compensation granted and compensation only to the extent of Rs.15,000/- be paid.

                        Counsel for the appellant states that compensation be further reduced. However, we are not agreeing with him. The amount ordered now i.e. Rs.15,000/- is in consonance with the loss caused to the respondent/complainant.

                        In view of above, this appeal stands disposed of. Impugned order is partly modified to the extent that in sub para [b] of para No.10 of the impugned order, the amount granted as compensation shall be reduced to Rs.15,000/- only. Rest of the order is maintained.

                        We make it very clear that if the payment is not made within three weeks from today, the interest granted shall fetch penal interest @12% p.a.

                        Certified copies of this order be sent to the parties, free of charge.

                                File be consigned to record room, after completion.
