ORDER

No. 1/28.04.2010.

Heard Miss Roychowdhury, the Ld. Advocate for the Revision Petitioner.  Though notice has not been sent to the O.P. at the stage of admission we are disposing of the revision application after considering the contention of the Revisionist.  Mr. Gobinda Das Mitra, the Ld. Advocate states that he has instruction to appear on behalf of O.P. though he has not filed any Vokalatnama.  As after hearing both the Ld. Advocates we find that present order does not affect either of the parties we are disposing the revision application at this stage.  The O.Ps are permitted to file Vokalatnama in the Office.  We have considered the impugned order dated 10.03.2010 and we find it does not make clear as to whether the evidence on Affidavit filed by the O.P. has been accepted or rejected though it is stated that the same is not in appropriate form.  In the facts and circumstances and in the interest of justice we make it clear that the O.P. is at liberty to file evidence on Affidavit in appropriate form and thereafter the Complainant will be entitled to file questionnaire and suitable dates thereafter may be fixed for filing reply by O.P. and thereafter BNA.  With the above clarification the revision petition is disposed of.
