Sh. Pradeep Gupta (in short complainant) filed a complaint under Section 12 of the Consumer Protection Act, 1986 as amended up to date inter-alia pleading therein that he is a businessman who frequently visit abroad for business purposes. Shahji Money Changers Pvt. Ltd. (in short OP) is engaged in the business of money changers and making arrangement for tour and travels. In April, 2014, complainant required a ticket to visit Dubai for business purposes. He paid Rs. 29,990/- in cash to OP. OP provided a confirmed ticket bearing PNR no. IVBM52 dated 05.04.2014 in the name of the complainant. Complainant was denied boarding pass on the ground that his ticket was not valid. Complainant was shocked. As he had an urgent business work in Dubai he purchased a business ticket worth Rs. 82,000/- to travel to Dubai. In May 2014 complainant visited the office of OP and demanded the money back but OP misbehaved. Hence the instant complaint seeking direction to the OP to pay to the complainant Rs. 1,11,990/- along with interest @ 24% per annum and Rs. 2,00,000/- as compensation for harassment.
Notice of the instant complaint was issued to the OP who appeared and contested the claim vide their reply. It is stated that complainant has filed a false claim. It is denied that they ever arranged any air ticket for the complainant. It is also stated that after receipt of notice of the instant complaint they made an enquiry about the complainant and came to know that ‘Complainant is doing a business of International and Domestic Air Ticket, Worldwide Hotel and Cruise Booking, Visa & Foreign Exchange Facility having the registered office at shop no. 23, Lehna Singh Market, Malka Ganj, (Near Hans Raj College), Delhi-110007’ and therefore he did not require services of OP to book ticket for him.
We have perused the material available on record.
During the course of arguments we called upon the complainant to show any document vide which OP acknowledged receipt of cash amount of Rs. 29,990/- from the complainant towards purchase of ticket bearing PNR no. IVBM52 dated 05.04.2014. Despite obtaining adjournments for this purpose he was unable to show any such document. OP has clearly denied that they received Rs. 29,990/- in cash from the complainant towards booking of an air ticket for him. OP has further alleged in Para 6 of their reply that after receipt of notice of the instant complaint they made an enquiry about complainant and came to know that complainant himself is engaged in business of international and domestic air tickets, hotel bookings, cruise tickets etc. and therefore, there was no question of complainant asking the OP to purchase air tickets for him. Complainant filed rejoinder. Complainant has not denied in corresponding Para 6 of his rejoinder that he is doing the business of international and domestic air tickets, hotel bookings, cruise tickets etc.
The complaint is accordingly dismissed. Copy of this order be sent to the complainant as per rules. File be consigned to record room.
