2.         Sh. Naresh Kumar Gupta, respondent has put in appearance in person.

3.         This revision petition has been filed against order dated 04.07.2016, vide which, exparte proceedings were ordered against the Revision Petitioner/Opposite Party by District Consumer Disputes Redressal Forum-II, U.T., Chandigarh (in short ‘the Forum’) for not putting in appearance before the Forum.

4.         It is stated by Counsel for the Revision Petitioner that due to wrong noting down of the date, the Counsel could not appear before the Forum on the date fixed and non appearance was not intentional.

5.         At the time of arguments, respondent/complainant, with all grace, said that let the matter be heard on merits.

6.         We appreciate the view taken by the respondent/complainant.           

7.         As per facts mentioned above, the Revision Petition is allowed. The order dated 04.07.2016, under challenge, is set aside.

8.         Counsel for the Revision Petitioner states that he will file reply and evidence, on record, within 15 days from today. It is made clear that if he fails to do so, no further opportunity shall be granted to the Revision Petitioner for the said cause. Copy of reply and evidence, in advance, be also sent to the respondent/complainant through registered post.

9.         Parties are directed to appear before the Forum on 23.09.2016.

10.        Order passed is subject to payment of Rs.2,000/- as cost. Let amount of cost be paid by the Counsel for the Revision Petitioner/Opposite Party to the respondent/complainant on the date fixed before the Forum.

11.        Certified copies of this order be sent to the parties, free of charge.

12.        Complete record alongwith a certified copy of this order be sent to the Forum, immediately, so as to reach there before the date fixed.

13.        File be consigned to the Record Room after completion.
