Neither the appellant nor his counsel is present. 

The order sheet indicates that the appellant or his counsel has not been appearing before this Commission on the date fixed, instead of they have been moving the adjournment application regularly on the date fixed.

The circumstances clearly indicate that the appellant does not seem to be interested to pursue the appeal before this Commission.

We, accordingly, do not have any other option except to dismiss the appeal in default of the appellant.

The appeal is, accordingly, dismissed in default of the appellant.

            The stay order dated 04.03.2009 stands vacated.
