Sh. M.P. Singh, learned counsel for the appellant and Sh. J.S. Tomar, learned counsel for respondent are present.
The present appeal has been preferred by the appellant against the impugned order dated 31.05.2012 passed by the District Forum, Dehradun in consumer complaint No. 02 of 2012; Sh. Devendra Singh Bisht vs. Proprietor, The Remond Shop, whereby the consumer complaint was allowed ex-parte and the opposite party was directed to refund the amount of Rs. 8,136/- to the complainant and also to pay Rs. 5,000/- for mental agony and Rs. 5,000/- for litigation expenses.
During course of appeal, both the parties have arrived at an amicable settlement and joint application has been moved to this effect on behalf of the parties. Both the parties have been identified by their advocates.
In compromise application, it is stated that there is no dispute remains between the parties. Therefore, on the basis of compromise, the appeal be disposed of.
Since, no dispute remains between the parties, therefore, we set aside the ex-parte judgment passed by the District Forum, Dehradun and the appeal is allowed in terms of compromise. The consumer complaint is dismissed.
Compromise application shall form part of the order. No order as to costs. The statutory amount deposited by the appellant be released in appellant’s favour.
