Aggrieved by the concurrent findings and order dated 26.06.2009 passed by the District Consumer Disputes Redressal Forum, Rohtak and thereafter order dated 29.07.2011 passed by the Haryana State Consumer Disputes Redressal Commission in FA No. 1030/2009, the original complainant has approached this Commission with the present petition. We have heard the counsel for the petitioner and have considered his submissions. The dispute related to the non-refund of the tuition fee paid by the petitioner to the respondent institute for his MBA course because he left the course as he got admission somewhere else. The institute denied the refund of the fee except caution money of Rs.2,000/- on the count that they have suffered loss of the fee as one seat vacated by the petitioner remained vacated through out the year. In our view both the Fora have taken a just view of the matter having regard to the entirety of the facts and circumstances of the case. The concurrent findings do not suffer from any illegality, material irregularity much less any jurisdictional error, which calls for any interference by this Commission. Dismissed.
