State Commission has dismissed the appeal as the petitioner had failed to comply with the mandatory provisions of Section 15 of the Consumer Protection Act requiring the appellant to deposit 50% of the awarded amount or Rs.25,000/-, whichever is less.  A couple of opportunities were given to the petitioner to deposit the amount.  Despite that, the petitioner failed to deposit the amount till the passing of the order, i.e., on 1.5.2006.

Provisions of Section 15 are mandatory in nature. The appeal could not be entertained until and unless the statutory amount was deposited as a condition precedent.  Dismissed.
