Present: - Complainant in person.          OP no.1 already exparte. Sh. A.S. Kalra, Advocate for op no.2.
The case is fixed for today for consideration in Maha Upbhokta Lok Adalat. Heard. On 03.11.2022, learned counsel for op no.2 suffered a statement that company is ready to pay Rs.6,000/- as full and final settlement after receiving the mobile set with all accessories within 45 days from the date of receipt of order. Complainant also suffered a statement that he is agreed with the statement given by learned counsel for op no.2 and will deposit the set with accessories with the service centre or with the counsel for company after receipt of copy of the order and in case op no.2 fails to make payment of Rs.6,000/- within period mentioned above, then ops be held liable to make payment of Rs.6,000/- with cost, compensation to the tune of Rs.5000/- with interest and present complaint may be disposed of accordingly.  In view of the statement of learned counsel for op no.2 as well as complainant, the op no.2 is directed to make payment of Rs.6,000/- to the complainant within 45 days from the date of receipt of order. The complainant will deposit the mobile set with all accessories with service centre of the company or with learned counsel for op no.2 well in time after proper receipt. In case op no.2 fails to make the payment of Rs.6,000/- to the complainant within above said period, then op no.2 will be liable to pay the amount of Rs.6,000/- to the complainant with interest @6% per annum from the date of this order till actual payment and in that eventuality op no.2 will also pay an amount of Rs.5000/- to the complainant as compensation. The present complaint stands disposed of accordingly being compromised. File be consigned to the record room.
