Heard Mr. M. Gogoi, learned counsel for the applicant and Mr. P. Deka, learned counsel, entered appearance on the behalf of the sole opposite party. As recorded in the order dated 09-01-2024,Mr.Deka appearing on the behalf of the sole opposite party submitted that the order impugned in the connected appeal FA 33/2023 was the subject matter in the appeal No FA 20/2016 which was disposed of by this Commission on 13/09/2018 thereby dismissing the said appeal. Upon such submission, Mr. Gogoi in order to verify the said submission of Mr. Deka sought time on 09-01-2024. Today Mr. Gogoi fairly submits supporting the submission made by Mr. Deka and sought for withdrawal of this application along with appeal FA 33/2023.In view of the same, this application stands dismissed.
