Sewa Singh Thekedar, respondent appeared through his counsel Sh.M.S.Bhatia, Adv. Case has been called several times since morning and ultimately at 4.00 p.m., but none appeared on behalf of the applicant. Whereas respondent appeared on execution of bailable warrants. He got recorded his statement that he has already complied with the orders of the District Forum dated 22.8.2012 as he has put the lenten on the building in dispute of the applicant in the month of September 2012 and completed the work and the applicant assured that he shall withdraw (the further prosecution of) the present complaint/execution application. All this shows that the applicant is not interested in prosecuting the present execution application. As such, same is hereby dismissed in default of want of prosecution. File is ordered to be consigned to the record room.
