Extract of Order No.28 dtd.04.10.2017

                                 Complainant being present in the Forum filed a Memo. Ld Counsel for OP-Insurance Company filed hazira. OP No.2 remains absent. Take-up the hearing of the case today and perused the memo filed by complainant today. It appears from the memo that OP-Insurance  has settled the claim amount of the complainant in the present dispute, to the tune of Rs.15,000/-(Rupees Fifteen thousand)only and filed a cheque of same amount bearing No.’081172’ of Axis Bank, in favour of CDVO,Kendrapara and complainant is agreed to receive the same as full and final settlement. As the said cheque is issued in favour of CDVO, Kendrapara in the capacity of ‘insured’. We direct the OP No.2,CDVO,Kendrapara to receive the cheque from this Forum and to handover the said cheque to the complainant for redressal of his allegation in connection to present dispute on completion of official formalities. As complainant is silent regarding any compensation/interest against the Op-Insurance Company, this Forum disposed of the dispute, considering the memo of the complainant. The OP No.2,CDVO,Kendrapara will hand over the said cheque to the complainant within 7 days of receipt of this cheque and order failing which action will be initiated as per the provisions ofC.P.Act,1986.

                                        Accordingly, the complaint is disposed of without any cost.
