ORDER NO. 2 DT. 6.7.10

It is stated by Mr. Somnath Saha,  Ld. Advocate for the DHr, that after the execution case was filed the Insurance Company has since repudiated the claim and, therefore, the DHr has been advised to challenge the said repudiation order and the present application for the execution of the earlier order is not pressed.  Accordingly, the execution case is dismissed for non-prosecution.  We make it clear that we have not decided any of the contentions on merit.
