Sh. William Akbar Chand, learned counsel for the applicant was present before the Commission on 01.04.2022. On 09.05.2022, the case was adjourned on the basis of adjournment application moved on behalf of the applicant and the case was fixed for hearing on admission on 14.06.2022, but the applicant did not appear before the Commission on 14.06.2022 and following order was passed by this Commission:
“Case is called out.
None is present on behalf of the applicant.
In the interest of justice, one opportunity is provided to the applicant.
Put up on 05.07.2022 for hearing on admission.”
Perusal of record reveals that the consumer complaint has been filed by Smt. Akshita Agarwal W/o late Sh. Nitin Agarwal, while the life assured had nominated his mother Smt. Anju Agarwal, as nominee in the insurance policy, who has been impleaded as opposite party No. 2.
Accordingly, the applicant was required to make submissions as to how the applicant is entitled to file this consumer complaint and for this reason, the consumer complaint was registered as miscellaneous application. However, none is appearing on behalf of the applicant for several dates.
It appears that the applicant is not interested in pursuing this matter further.
Accordingly, the miscellaneous application is dismissed in default of the applicant.
