ORDER

          State Commission, in order to come to the conclusion that the petitioner was guilty of suppression of material facts relating to his health while filling up the proposal form, in para-8 has recorded the following finding :

“The discharge summary of the deceased, which has been filed before District Forum and which is at page No.89 of record the District Forum, shows that the deceased was admitted in the hospital on 02.08.04 in the night.  He was having complaints of discomfort and respiratory conjunctions.  ECG was taken.  Other investigations were also done.  He remained in the hospital up to 06.08.04 and it was diagnosed that he was suffering from Ischemic Heart disease and treatment therefor was prescribed.  Thereafter, the disputed policies were purchased by him, and in the proposal form therein, facts regarding admission in the hospital, getting treatment and diagnosis of Ischemic Heart disease and Hypertension were not at all mentioned.”

 

          We agree with the view taken by the State Commission that the petitioner was guilty of suppression of material facts relating to his health while filling up the proposal form and is not entitled to the benefits under the policy in question. Dismissed.
