Heard Mr. R.K. Mour, learned counsel, appearing for the appellant.
The judgment dated 1-8-2015 passed in C.C. No. 13/2007, by the learned District Commission, Golaghat, is put under challenge in this appeal, thereby challenging the operative portion of the said judgment, which is reproduced here-in-below.
“In the result, the complaint petition is allowed on contest. The O.P. No. 1, the Senior Divisional Manager, National Insurance Co. Ltd., Kolkata and O.P. No. 2, the Manager Golden Trust Financial Services, Kolkata are directed to pay the amount of Rs. 90,000/- (Rupees ninety thousand only), to the complainant along with simple interest @ 9% per annum from the date of filing of the complaint petition i.e. 31-5-2007 till realization of the entire amount. The O.P. No. 1 and O.P. No. 2 shall deposit the awarded compensation with interest thereon in this Forum within 60 days from the date of judgment and award.”
Being aggrieved by the said judgment, the opposite party No. 2 in C.C. No. 13/2007, the Manager, Golden Trust Financial Services, Kolkata, preferred this appeal. It is submitted by Mr. Mour that the total awarded amount to the respondent No. 1, was satisfied by the respondent No. 2 in this appeal, as opposite party No. 1 in C.C. No. 13/2007.
In view of the same, the appellant has no further grievance and as such, on the submission of Mr. Mour, this appeal stands closed and disposed of. Interim order, if any, stands vacated.
Registry shall refund the statutory amount to the appellant.
Lower Court Record be sent back along with a copy of this order to the learned District Commission.
