Heard learned counsel for the applicant-opposite party No.2.

Learned counsel for the opposite party No.2 has stated that the cheque of decreetal amount has been sent to the complainant on his address in the United States but the same has been returned undelivered by the postal authorities. Hence, it is prayed that appropriate orders be passed in respect of the deposit of the decreetal amount.

          The decreetal amount be deposited with this Commission. Notice of deposit be given by the opposite party No.2 to counsel for

the complainant. In case after deposit the said amount is not claimed by the complainant within a period of 45 days, the said amount be invested in the fixed deposit. Counsel for the opposite party No.2 states that the cheque shall be deposited in the name of the Registrar within three weeks.

          The Registry shall send a copy of this order to counsel for the complainant for information and necessary action.

Application stands disposed of in aforesaid terms with no order as to costs.
