Presented by Sri B.K. Pati, Member:- The Complaint pertains to deficiency in service by the Opposite Parties with the following facts and grievance of the Complainant. The Complainant has been given power supply through temporary arrangement. He has deposited a sum of Rs.13,999/-(Rupees thirteen thousand nine hundred ninety nine)only on Dt. 16/10/2005 with the Opposite Parties being asked by them for use of poles as a permanents and safe supply of power to his house which they have not yet done till date. The Complainant also claims to have deposited Rs. 10,000/-(Rupees ten thousand)only with the Opposite Parties for transportation of materials from Electrical Division, Burla, for the purpose. The Opposite Parties in their version contend that they had already stored the materials, such as poles and electric wires to give permanent connection to the house of the Complainant by erecting poles. The Poles could not be erected because some land owners objected to the erection of the poles on their lands. Taking of electric line through another route enhances the distance by 150(one hundred fifty) meters and an enhanced expenditure for the purpose. Though the Complainant was intimated about this fact vide their letter Dt. 27/07/2007, he has not responded to it. However the Complainant is getting uninterrupted power supply to his house. At the time of hearing of the case the advocate for the Opposite Parties submitted that, if the Complainant shows the land and place where-in the poles are to be erected, than the Opposite Parties will erect the poles and make permanent arrangement for supply of power to the house of the Complainant with the condition that if the expenditure exceeds the amount deposited by the Complainant, then he will have to pay the extra amount to the Opposite Parties and if the expenditure is below the amount deposited then the Complainant will be refunded the surplus amount of the deposit. The Advocate for the Complainant agreed to the proposition of the Opposite Parties. In view of the above fact and circumstances, the Complainant is directed to show to the Opposite Parties the land on which the poles are to be erected and the Opposite Parties are directed jointly and severally to erect the poles for permanent supply of power on the land shown by the Complainant with in 30(thirty) days from the date of the Order. If the expenditure for the afore said work exceeds the amount deposited by the Complainant, he shall pay the extra amount and if the same is below the deposited amount then the Opposite Parties shall refund the surplus amount to the Complainant. The Order is made on the mutual under standing and consent of the Parties and the complaint is disposed of accordingly. No cost /compensation.
