Shri Sundarlal Behera, President :- The brief facts of the complaint case is that, the complainant is a consumer of O.Ps. Vide consumer No. 41722303-1980, old Account No. CTD-D-53(4172/02/38 of 2014/15). The complainant was paying the electricity bill regularly. The complainant receipt a bill of Rs.2742/- only since 2014-15 and paid the same but while she checked online she found the bill amount of Rs.2323/- only i.e. excess amount of Rs.419/- only. The complainant was having 1.00KW of load but the O.Ps. extended to 2.00KW for which the complainant is paying excess amount. One Ranjeet Dehery (Bill Collector) has given excess bill on dtd.18.11.2017 for Sept.-Oct,2017 but after raising objection the said bill collector turn out the bill and given afresh bill of Rs.241/- only. Raising all the allegations the complainant filed this case.
On service of notice, the O.Ps appeared. The O.Ps filed a petition on the ground that the matter of dispute has already settled between the parties outside the court and an electricity bill has been corrected and filed a copy of statement in place of filing of written version.
Heard from the complainant, gone through the case and materials available on record. The complainant denied on any settlement between the parties. The complainant has filed Xerox copies of several nos. of electricity bills and money receipts and also printout copy of online payment pages of WESCO. In the online pages there are discrepancies found in the bill amounts which the O.Ps. are also agreed and in the account statement the O.Ps. Mentioned in their hand writing on amount of Rs.191.40P as negative arear amount for the month upto Feb,2018. It is also found that in bills issued by the O.Ps. there were 1.00KW of load factor since-2014-15 but currently it is 2.00KW of load for which the complainant is paying the extra charges.
In view of above facts and circumstances, the O.Ps are found deficient in their service, hence the complaint petition is hereby allowed with following directions;-
ORDER
- The O.Ps. are hereby directed to issue the actual electricity bills as per meter readings in every month and to return / make adjustment of Rs.491/- (Rupees four hundred ninty one) only in forthcoming electricity bills of complainant.
- The O.Ps. are further directed to reduce the load factor from 2.00KW to 1.00KW in the electricity bills of the complainant.
- The O.Ps. are also directed to pay a sum of Rs.8,000/- (Rupees eight thousand) only towards mental agony, harassment including litigation cost to the complainant.
- All aforesaid orders are to be carried out within 30(thirty) days from the date of receipt of this order, failing which the O.Ps. shall be liable for interest @12% per annum for realization.
Accordingly the case in hand is disposed of.
