This complaint filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.
2. The case of the complainant in shot is that he has booked one of the banquet hall of the opposite party for conducting the reception in connection with the marriage of his son. The proposed reception was on 06.07.2020 in between 5.00 pm to 9.00 pm. Due to the unexpected restrictions imposed by the Government the complainant was forced to postpone the marriage of the complainant’s son. This fact was informed to the opposite party and requested for refund of Rs.1,14,480/- which was paid by the complainant to the opposite party at the time of booking their hall. The opposite party returned Rs.97,920/- to the complainant by online transfer and informed the complainant that there are some legal issues in returning the remaining Rs.16,560/- to the complainant. According to the complainant all the managements of the auditoriums have returned the entire amount to the persons those who have cancelled the function due to the restrictions enforced by the Government administration in view of the Covid 19 pandemic. The complainant approached this Commission alleging deficiency in service and unfair trade practice on the part of the opposite party and for redressing his grievances claiming compensation from the opposite party.
3. When the case came up for consideration today the complainant filed a memo stating that he has received Rs.16,560/- being the balance amount to be paid by the opposite party to the complainant. The complainant further submitted that he has no grievances against the opposite party, in view of the refund of the amount and submitted that he is not willing to further proceed with this case against the opposite party. The memo filed by the complainant accepted and recorded. In view of the refund of the amount by the opposite party to the complainant, we find that this is a fit case to be dismissed as settled.
In the result, the complaint is dismissed as settled. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
