1. Alleging deficiency of service and unfair trade practice  the complainant filed this case against the Opposite parties before this forum for a direction to release the bonus amount of Rs.5,000/- with 15% interest per annum till realization.
2. Shorn of unnecessary details, the brief fact of the case is that the complainant had agricultural land measuring an area of AC.3.92 decimals for production of paddy. The complainant sold some paddy to the O.P.NO.1 for which the O.P.No.1 paid Rs.98,700/- in favour of the complainant which was deposited in SB account of the complainant. As per State Government every farmers is entitled to get Rs.100/-per quintal as special drought assistance (SDA) and maximum to 50 quintals. So as per decision of State Govt. he is entitled to get Rs.5,000/-/Special drought assistance (SDA) towards bonus from the O.P.No.1.After  several approaches the O.P.No.1 did not take any steps to release the bonus/SDA amount. The complainant reported the matter before the O.P.No.2 on 16.1.2017, but he also remained silent. The complainant filed R.OR, rent receipt, SB A/C statement, Voter Identity card, ration card and Adhar card.
3.   Being noticed the O.P.NO.1 appeared in this case and filed counter in this case. The impleadment of O.P.No.2 is not pressed by the complainant In his counter the O.P.No.1 stated that the complainant has sold 70 quintal of paddy to the Society against Ac.3.93 of land who is the agent of OSCSC Ltd, Boudh and on whose behalf the society is purchasing paddy. As per declaration of State Government towards Special drought assistance Rs.100/- per quintal and up to maximum 50 quintals with certain terms and condition, the complainant is not entitled to Rs.5,000/-.As per guideline of Food Supplies and Consumer Welfare department, Govt. of Odisha. “Whether farmer sold paddy at pre drought productivity rate 18 quintals per acre for irrigated land and 12 quintals for non-irrigated land, SDA would not be admissible to them.  Sanction of SDA in these cases would invite Audit objection”. As per  guideline farmers sold paddy at pre drought productivity rate are not be accorded with the benefit of SDA.He also filed Spl. drought assistance guidelines dtd.8.11.2016 of Food Supplies and Consumer Welfare Department, Govt. of Odisha .The table of disbursement of Special drought assistance  to affected farmers for the KMS 2015-16 Manupali Society shows that complainant sold 70 quintals paddy to the society contravening the limit fixed by Food Supplies and Consumer Welfare Department, Govt. of Odisha.
4.  Taking into consideration of the case of the complainant, counter filed by the O.P.No.1, documents filed by them, we dismiss the case of the complainant against the O.Ps without cost. This case is disposed of accordingly.
