Order No.3 dt.10.05.2015:

            The case of the Complainant is that joint S.B. Account bearing No.963 was opened in his name and his brother Parameswar Sahoo with the Arnapal S.C.S.Ltd. on 04.08.2010 and deposited Rs.25,566/- in the said account  under Salandi Sanskar Yojana.  The Complainant approached the O.P. to release half of his share for his daughter’s marriage but the O.P. for extraneous reasons denied disbursement of the said amount. Hence, prayed that the O.P. be directed to release 50% of his share and for payment of compensation of Rs.20,000/- to him.

            Due to urgency of the matter, taking into consideration the marriage of the Complainant’s daughter, this Forum on the interim petition of the Complainant directed the O.P. on 01.06.2015         to release 40% of the share of the Complainant lying in the aforesaid account No.963 immediately.

            The O.P. appeared in this case and filed written version stating that Rs.25,500/- was received in favour of Complainant Arakhita Sahoo and his brother Parameswar Sahoo. As the amount was deposited in the joint account and the share of Complainant was unknown, the request of the Complainant to disburse 50% of his share was denied. Further, the O.P. called for both sides for settlement of the dispute but they did not turn up. However, as per direction of the Forum, 40% of the share of the Complainant amounting to Rs.10,200/- has already been paid to Complainant.

            Having heard both sides and upon perusal of record, we are convinced that the O.P. could not disburse the amount of the Complainant as the share of Complainant was unknown. The O.P. during course of hearing of the case submitted that he has no objection if the rest 10% of the share of Complainant be released. If the O.P. has no objection to disburse rest 10% of the share of the Complainant and the brother of the Complainant’s did not turn up for discussion with the O.P. as per his version, we have no other alternative than to direct the O.P. to disburse rest 10% of the share of the Complainant. Accordingly, we direct the O.P. to disburse rest 10% share of the Complainant immediately. Thus the case is disposed of without costs.
