ORDER

Decree Holder absent. Judgement Debtors/opposite parties furnished the order of the Hon'ble National Commission in Revision Petition 1414/2008 dated 01.09.2008 against the order dated 07.01.2008 in Appeal No. 710/2002 of the State Commission, Kerala, wherein the Housing Board was directed to allot another alternative plot subject to the availability at the rate on which the plots are being allotted to other persons. As per the said order, in case no such plot is available or is not


 

accepted by the complainant, in that situation, Housing Board was directed to refund the deposited amount of Rs. 4,000/- with 18% interest throughout from the date of deposit till payment. Judgement Debtors filed affidavit dated 27.02.2009 stating that at present no plot is available for allotment in any of the schemes of the Kerala State Housing Board, that in compliance with the order of the National Commission it has been decided to refund Rs. 24,675/- (towards the amount of Rs. 4,000/- with 18% interest) as per cheque No. 038528 dated 02.02.2009, that Decree Holder has received the said cheque and that Judgement Debtors have complied the direction in the order of the National Commission. Along with affidavit, Judgement Debtor has furnished copy of the acknowledgement card, the letter and proceedings order also. In view of the above, there is no purpose in continuing the E.P. Hence E.P is closed.
