                                                       ORDER

SMT.P.RAMADEVI : PRESIDENT:

              The case of the complainant is that  he availed Neethi gas connection through opposite party No.1 on  deposited about  Rs.10,000/-.  When  the value of this  gas cylinder is very high   he  surrendered  the said connection but the   opposite parties did not refund the said amount. Hence the complaint praying for an order against opposite parties for the refund of deposited amount with compensation.

2.    Notice issued to opposite parties , 2^nd opposite party called absent  and set exparte.  Ist  Opposite party filed version stating that the bank is only a commission agent of the 2^nd opposite party    accepting  a  very nominal amount of Rs.10/- per gas cylinder and supplying the  Neethi gas  through their  retail outlet. Ist opposite party also admitted that they collected Rs.5750/- from the customer at the time of installation of gas connection and remitted Rs.5650/- to the 2^nd opposite party’s account and  the Ist opposite party get only Rs.100/-as commission for  neethi gas connection

3..  Complainant   examined as PW1 and Exts. A1 & A2 marked.

   During evidence, PW1 deposed that  he  deposited the amount  at the time of  availing  gas connection.  He further stated that the rate of gas cylinder is very excessive  so  he  discontinued  the  connection and also he  surrendered  the  gas cylinder and regulator to  opposite party No.1and they issued surrender certificate to him.  Therefore we are of the view that  the complainant is entitled   for Rs.  5750/- the amount de[posited by the complainant.

           Hence the complaint is allowed and  2^nd opposite party is  directed to refund Rs. 5750/- to the complainant within one month from the date of receipt of copy of order.  Failing which , the amount of Rs. 5750/-  will carry interest @ 9 % per annum form the date of complaint  till payment. Ist opposite party is exonerated from liabilities
