Heard. Complainant and authorized agent appeared. Complainant applied for getting the Birth Certificate of her daughter "Rinta Jose", to the opposite party with the prescribed fee of Rs.5/- on 22/06/2009. The child was born at Community Health Center, Nedumkandam on 17/07/1990. The copy of the letter issued from Community Health Center Nedumkandam, stating that the child was born there and the birth was registered in Nedumkandam Grama Panchayat, the date of delivery of the complainant was on 17/07/1990 and it was a female child. The copy of the receipt issued from Nedumkandam Grama Panchayat for the application given by the complainant for getting the birth certificate dated 22.06.2009 is also produced. The complainant applied this with the Certificate from the Community Health Center Nedumkandam, stating the Birth of the child. The opposite party never issued the Certificate as per the application. This is very essential for the future studies of the child. Opposite party and Counsel appeared. Opposite party submitted that the register of birth in the relevant period has been destroyed due to old and the matter was duly reported to the Office of the Director of Panchayat. They have admitted that the complainant applied for birth Certificate of her daughter to their Office. So we think that the Birth Certificate is very essential for the future studies of the child. The complainant should not suffer because of the distruction of the register in opposite parties office. The opposite party can peruse the Certificate from Community Health Center and the relevant records from there. Hence the opposite party is directed to issue birth Certificate to the complainant for her daughter within 30 days of receipt of a copy of this Order.
