Complainant present. Heard on the question of Maintainability. It is the case of complainant that the shop room taken by him in auction from the opposite party Panchayat does not have electricity connection. Hence this complaint is filed by him to direct opposite party to provide electricity supply and to pay compensation of Rs.2,00,000/-. On perusal of complaint and hearing the submissions made by him we understand that complainant has bid the room on lease in an auction conducted by panchayat. It is held in 2009 CTJ 486 (SC)(CP) that there is no hiring or availing of service by the person bidding at the auction nor is the seller or lessor a trader or service provider. The lease premium paid by the successful bidder of the site is the consideration for lease and not the consideration for any service or for provision of any amenity. Thus the grievance of the complainant does not give rise to a complaint or consumer dispute. Hence complaint dismissed as not maintainable.
