Order Dated:-12.09.2023

Both the side present. Heard. Learned advocate for D.Hr submitted that as per order of the Commission the entire amount has been deposited with the J.Dr. As per order dated13.01.2014 of this Commission the D.Hr. has to deposit Rs. 73,603/- +Rs. 1000/- for closure of loan account +restoration charges. The amount has been deposited on 31.03.2014 towards closure of loan and with accrued interest condoling to Rs. 90,684/- and on the same day restoration charges of Rs. 1000/- was deposited vide receipt No. 15 & 16 dated 31.03.2014.

Perused the documents submitted by the D.Hr. As per order of this Commission the D.Hr. has already deposited the demand amount. Later on the J.Dr. demanded the restoration charges which has already been hiked. As the D.Hr. complied the order of the Commission further demand of restoration charges is not proper. Accordingly, the D.Hr. is directed to execute the lease deed within three months of this order.

Learned advocate J.Dr. submitted that the D.Hr. is liable to pay Rs. 7419/- till 30.09.2019. As the restoration charges has been paid by the D.Hr. contention of the J.Dr. is not acceptable, with this observation the case is closed.
