JUDGMENT

 

JUSTICE SRI.K.R.UDAYABHANU  : PRESIDENT

 

          The appellant is the complainant in CC.126/05 in the file of CDRF, Alappuzha.  The complaint stands dismissed. 

          2. The matter in is the dispute with respect to the additional bill issued for a sum of Rs.13,500/-.

         

         

           3.  evidence adduced consisted of the testimony of PW1, RWs 1 and 2; Exts.A1 and A2, B1 to B5.

          4. The Forum has disposed of the matter with a three sentence order that “We perused the pleadings and evidence.  The case of the opposite parties  more probable than the case of the complainant.  There is no deficiency in service on the part of the opposite parties”.

          5. We find that the order is not a judicial one.  The evidence has not been considered.  Hence the order is set aside.  The matter is remitted back to the Forum.  The Forum is directed to dispose of the case by a considered order.

          5. The matter stands posted before the Forum on 27.7.2010.

          Office is directed to forward the copy of this order along with the LCR to the Forum urgently.
