1. The case of the complainant is as follows :
The complainant is a domestic category consumer under the 2nd opposite party. During the renovation work of her home, the meter board fell down. At the instance of the 2nd opposite party, the complainant remitted the required fee towards inspection and application fee for re-installation. Thereafter, there was no response. The 2nd opposite party and the subordinate staffs have been purposefully delaying the erection of the meter board for their own reasons. The above conduct of the 2nd opposite party amounts to deficiency in service. The complainant is entitled for the erection of the meter board and restoration of the supply with immediate effect. She is also entitled to get compensation and costs. Hence this complaint.
2. Version of the opposite parties :
On 12-12-2009, the 2nd opposite party found that the electricity meter of the complainant had been tied to a nearby rubber tree and covered with a plastic sheet since the building having the service connection was completely demolished. The 2nd opposite party directed the complainant to arrange a roofed place to reinstall the same. On 15-12-2009, she submitted an application to shift the meter and to provide supply. So the 2nd opposite party directed the complainant to arrange a roofed place within one week to reinstall the meter. On 19-12-2009, the 2nd opposite party inspected the premises and found that no arrangements were made by the complainant as directed by them. A site mahazar was prepared at the time of inspection. On 28-12-2009, a letter was sent to the complainant to submit the completion report within 7 days, but there was no response. On 08-10-2010, the complainant produced order of this Forum directing the K.S.E. Board to install the meter board and provide supply. But the installation wiring has been completely demolished and no roofed place was arranged by the complainant to install the meter board. On 12-01-2010, the complainant caused a letter stating that construction of the new building is completed and meter can be shifted. Since due to lack of wiring installation which had to be provided by the complainant as directed by the opposite party wherein she failed. The opposite party offered to fix the meter alone without power supply. The complainant is solely responsible for the delay in effecting connection. There is no deficiency in service on the part of the opposite parties.
3. No oral evidence was adduced by the parties. Exts. A1 and A2 and Exts. B1 to B7 were marked on the side of the complainant and the opposite parties respectively. Heard the counsel for the parties.
4. The points that enunciated for consideration are :-
i) whether the complainant is entitled to get the meter board
erected and to restore the power supply?
ii) Compensation and costs of the proceedings?
5. Point No. i) :- During the proceedings in this Forum, at the instance of the complainant as per the order in I.A. No. 05/2010 dated 04-01-2010, this Forum directed the 2nd opposite party to erect the meter board of the complainant and provide the electric supply. Though at the outset, the 2nd opposite party raised hue and cry against the above order, later they have complied with the same completely. Thus, the grievance of the complainant stands redressed squarely.
6. Point No. ii) :- Apparently, the complainant is a promulgator of Christian faith which is supposedly based on love, forgiveness and patience. It seems that there has been a misgiving between the parties which of course now has been resolved amicably. Why matters should be further drawn does not seem to be conducive. No costs and compensation are called for under such circumstances. We maintain so.
7. In view of the above, the proceedings in this complaint stand closed.
