(by Adv. Vellarada Vipin Raj P.) ORDER HON’BLE JUSTICE SRI. K. SURENDRA MOHAN: PRESIDENT This is a petition filed by the complainant in C.C.No.182/2022 of the District Consumer Disputes Redressal Commission, Kottayam (the District Commission for short). The respondents herein are the opposite parties in the complaint. According to the Petitioner, he is a person aged 78 years and in poor health. According to him, though he had sought for an adjournment on 24.01.2023, the 3rd respondent objected to the request. Therefore, the matter was kept aside for being taken up later. The Petitioner submitted to the Commission that though he had engaged a counsel in the matter, it was his desire to present his case personally, as he was more conversant with the facts giving rise to the complaint. His case is that, the President of the District Commission was showing a hostile attitude towards him. Various other personal allegations are also made against the President of the District Commission. The President is arrayed as the 3rd respondent in this Transfer Petition. 2. The counsel appearing for respondents 4, 5 and 7 filed objections to this petition. It is pointed out that, the allegations levelled against the President of the District Commission are baseless and that it was the Petitioner who had been conducting himself in an unreasonable manner. It is pointed out that, the Petitioner is aged and in poor health. He is from Kottayam and therefore transfer of the case to any other place would only put him to more hardships and trouble. Therefore, according to the counsel this petition is only to be dismissed. 3. Heard both sides. We have considered the contentions put forward. We are not satisfied that any acceptable grounds have been made out for transfer of the case from the District Commission, as sought for by the Petitioner herein. In view of the above, this petition is dismissed, no costs. JUSTICE K. SURENDRA MOHAN | : | PRESIDENT | AJITH KUMAR D. | : | JUDICIAL MEMBER | K.R. RADHAKRISHNAN | : | MEMBER |
