       The facts of the complaint in brief are that the complainant is a resident of Balal Grama Panchayath and due to scarcity of drinking water he approached the opposite party for arranging the drinking water as  ordered by the Hon’ble Chief Minister of Kerala.  But the opposite party fails to comply the direction of the  Chief Minister, then he approached  through  the Hon’ble MLA.  Even then the opposite party is not ready to  help the complainant and then he  dug a bore well in his property and for digging the well he spent Rs.39,100/-.  According to complainant  because of the adamant  attitude and negligent act of the opposite party he spent the amount.  Hence this complaint is filed alleging deficiency in service  against opposite party and prayed for the recovery of the amount spent for digging the well in his property.

    Opposite party served notice and appeared through  counsel and filed their version.  Opposite party denied all the allegations made against them by the  complainant and raised an issue  regarding the maintainability of the complaint  before this Forum.  According to the opposite party the complainant is not a consumer as per the Consumer Protection Act.

    Heard both sides on issue regarding  maintainability. Here the complainant has not received any service from opposite party for consideration.  There is no consumer relation between the complainant and opposite party.  Hence the complaint is not maintainable  before this forum and it is dismissed.
