Manager, : Opposite parties Bhavani Auto Distribution, 1/4996.A,Kamala Buildings, Nadakkavu Road, Kozhikode. ORDER SRI.K.T.SIDHIQ: PRESIDENT In nutshell the case of Abdul khader is that the Gas cylinder kit purchased by him worth Rs.1181/- for attaching it with his Auto Rikshaw became defective within two days of its purchase and the 2nd opposite party has not replaced it. Hence the complaint claiming refund of the purchase value of cylinder kit with compensation and cost. 2. Opposite party No.1, Secretary Hosdurg Taluk Autorikshaw Drivers Co-op Society Ltd filed version and denied the allegations. Opposite party No.2 Manager, Bhavani Auto Distributors filed their version and admitted that they are ready to replace the cylinder kit. 3. As per the direction of Forum, opposite party No.2 brought a new cylinder kit and entrusted it with opposite party No.1 Society for delivering it to Abdul Khader. But he did not turn up to take the cylinder kit. On the date of hearing on 21/7/08 also Abdul Khader remained absent and no evidence adduced in support of his case. Therefore, we allow the complaint and Abdulkhader is directed to take the new gas cylinder kit from the office of the Secretary Hosdurg Taluk Autorikshaw Drivers Society Ltd. after issuing receipt for the delivery within 2 months from the date of receipt of copy of order.
