The case of the complainant is as follow:


 

He had approached the opposite parties for repairing the rice cooker. The Ist opposite party was the technician and the 2nd opposite party was the service centre who conduct the repairs. The opposite party had assured the complainant that the cooker will be functioning only after replacing the coil. The opposite party has not repaired the cooker even after repeated demands. Hence this complaint.


 

The notice was served with the opposite parties. The Ist opposite party did not accept the notice from this forum. The 2nd opposite party accepted the notice and they appeared through

counsel. But they did not file the version. So, the opposite parties were set expartee.


 

The complainant filed proof affidavit. Heard complainant. The sworn proof Affidavit of the complainant is un-challenged by the opposite parties. So we have no reasons to dis-believe the case of the complainant. We are of the opinion that the case of complainant is to be allowed.


 

In the result the complaint is allowed as follows: We direct the opposite parties to return the rice cooker after repair in working condition to the complainant or if not possible the opposite parties are directed to pay Rs.2000/- to the complainant and pay Rs.500/- as cost of these proceeding. The order shall be complied with within a period of one month from the date of receipt of this order.
