ORDER

CC No.106 of 2022.

Gurudwara     Vs.    UHBVNL.

 

Present:  Sh. JS Kler, Adv. for the complainant.

               Sh. Bhupinder K. Shandilya, Adv. for the respondents.

                                                                            

         Mediation Cell referred the matter back to this Commission alongwith settlement report Ex.P. The settlement Ex.P is legally workable.

            In view of the settlement Ex.P between the parties, without making any adverse comment on the conduct of the complainant or the opponents as matter amicably has been settled between the parties, the complaint is disposed off as per settlement Ex.P in the following manners:-

1. Complainant will deposit Rs.80,000/- as part payment against the outstanding balance.
2. To clear the dispute, a check meter will install by the respondent and average reading will be taken for the period disputed i.e. 31.12.2020 to 22.01.2021.
3. After getting the fresh bill from the UHBVNL Department, the complainant will deposit the bill within 7 days.
4. The final bill will be issued after getting the reading from the check meter within the period of 6 months.
5. Department will not take any action to disconnect or impose any fine during these 6 months and during these 6 months period, if scheme beneficial to the party, it will be considered.

 

         However, in clause-1, the last date of deposit of Rs.80,000/- has not been mentioned in the settlement and keeping in view of clause-2 of the settlement Ex.P, the complainant shall deposit amount of Rs.80,000/- on or before 31.12.2022.

             Parties are left to bear their own cost of litigation. File be consigned to the records.
