Shri S.L.Behera, President :- The brief facts of the complaint case is that, the complainant has taken a commercial electrical connection with having Consumer No. 417215012988 and he was paying the electricity bills regularly to the O.P. The complainant was having outstanding dues of Rs.6,244/- only due to some unavoidable reasons. The complainant has paid Rs.5,000/- only on dtd. 25.08.2016 but the O.P disconnected the electricity connection on dtd. 19.12.2016 without any prior notice. The complainant was ready to clear the dues but the O.P did not receive and insulted the complainant, hence this case.
On service of notice, the O.P appeared and filed Written Version through his counsel admitting the facts of electricity connection and submitted that the complainant is a consumer vide consumer No. 417215012988 and due to laches of complainant of having dues of Rs.6,230/- only up to November,2016, the electrical connection was disconnected and further it was restored as per the order of this Hon’ble Forum. To avoid the payment of arrear and to escape from the liability the complainant filed this case which is liable to be dismissed.
Heard from the parties, gone through the case and materials available on record. The complainant is a consumer of O.P bearing consumer No. 417215012988. The complainant was having accumulated arrear of Rs.6,230/- only upto November,2016. The electrical supply was restored by the O.P by complying the Misc case order passed by this Hon’ble Forum dtd. 30.12.2016. The complainant has paid Rs.6,250/- only on dtd. 05.01.2017. The O.P. has filed copy of disconnection notice wherein it has mentioned refused to signed but without having any signature of witness which fails to prove that whether the said notice was properly served to the complainant or not ? And basing on the said notice the O.P have disconnected the electric line which amounts to deficiency in service.
Hence the complaint petition is hereby allowed, directing the O.P to issue afresh electricity bill and pay a sum of Rs.2,000/- (Rupees two thousand) only to the complainant towards harassment, mental agony including litigation costs, which may be adjusted in the next / further electricity bill/ bills of the complainant.
Accordingly the case is disposed of.
Order pronounced in the open court today the 24th day of July’ 2017 and copy of this order shall be supplied to the parties as per rule.
