Indisputably, the complainant applied for tube well connection, qua, his land, situated within the Revenue Estate of Village Fatehgarh, District Yamuna Nagar. As per the version of the respondents made into the written statement, when they prepared the estimate of Rs.2,51,576/- for erection of 15 poles and releasing of tube well connection, in favour of the complainant, then, complainant had not deposited an amount of Rs.2,51,576/-.
Keeping, in view the controversy, between the party, matter was referred to the mediation cell of this Commission, for settlement of the matter and which has been settled and to identify settlement dated 30.11.2023, Ex.P1 is marked on it.
In view of the statement Ex.P1, without making any adverse comment, on the act and conduct of the parties, without touching to the merit of the case, the complaint is partly accepted, against the respondents, and the release of electricity connection, in favour of the complainant, on the basis of application, qua, which demand notice dated 7.7.2015 Ex.C3 was issued by the respondents, is kept on hold, till the release of electricity connection to the consumer, being nearest one, to the tube well site of the complainant, by the respondents and after the release of electricity connection, in favour of nearest consumer to the tubewell site of the complainant, by the respondents, as mentioned hereinbefore, the respondents will also release the electricity connection, subject matter of demand notice Ex.C3, in favour of the complainant. It is made clear, in case, the complainant is required to perform certain obligation, on his part, such as, deposit of payment in view of revised estimate, then, the respondents will inform him, in this regard, in writing, giving reasonable time of one week or two week, for deposit of the same and then, complainant will deposit the same with the respondents, in a given period, in that eventuality, respondents will release the electricity connection, in favour of the complainant, subject matter of demand notice Ex.C3, within the period of one month from the completion of formalities by the complainant. It is further made clear, if as already mentioned hereinbefore, if the complainant still feels agreived from the action of the respondents, then, he may file execution petition against the respondents, to enforce this order or may file fresh complaint against the respondents, raising his grievance, and in fresh complaint, he will mention the particulars of present complaint and its fate. Due to peculiarities of the facts, parties are left to bear their own cost of litigation. File be consigned to the records.
